TERMS AND CONDITIONS FOR “CANCUN.COM CEO SEARCH” CAMPAIGN

1.
These terms and conditions of application, including information on how to participate and job details (Terms), apply to the Campaign and application into the Campaign is deemed acceptance of these Terms.
2.
Submission into the Campaign is also deemed as acceptance of the Cancun.com's Website Terms and Conditions, which can be viewed at http://ceo.cancun.com/terms-and-conditions.
3.
The Campaign is being organized and managed by Cancun.com, which is a part of Travelpass Group, located at 2961 W Maple Loop Dr, Lehi, UT 84043. Cancun.com and the Company are used synonymously in these terms and conditions.
4.
Partners in the campaign include numerous Cancun tourism organizations, airlines, accommodations, attractions, and restaurants.
5.
The Submission portion of the campaign will be open on November 8, 2017 at 9:00am Mountain Standard Time and closes on December 17, 2017, at 11:59PM Mountain Standard Time. (Campaign Period). Applicants will need to calculate their local start and close dates and times based on the time zone in their location.
6.
Submission into the Campaign gives eligible applicants the chance to become Cancun.com's Cancun Experience Officer (CEO)
7.
Submission into the Campaign is open to individuals aged 18 years and over as of January 1, 2018, who are able to obtain an appropriate visa that will allow them to work in both the United States excluding:
a.
management, employees, directors and contractors of Cancun.com, its related entities and other agencies, firms or companies associated with the Campaign (including suppliers of jobs); and
b.
a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 7(a) of these Terms.

CANCUN.COM CEO QUALIFICATIONS & CRITERIA FOR SELECTION

CEO applicants and finalists (whether in teams or as individuals) will be selected based on qualifications including but not limited to:
1.
Content, creativity and originality of candidate’s video application.
2.
Proficiency with social media platforms (Facebook, Instagram, Twitter, etc.)
3.
Technical demonstration of digital photography and video skills.
4.
Versatility and creative use of visual engagement tactics.
5.
Knack for crafting stories through various mediums.
6.
Ability to authentically engage, sustain, and mobilize audiences.
7.
Exhibited, positive self-motivation.
8.
Displayed comfort and ease during media interviews.
9.
Acts responsibly and demonstrates integrity and good moral character.
10.
Efforts to become engaged in surrounding community, particularly in local "VolunTourism" activities; generous of spirit in helping others.
11.
Ability to withstand physical demands of extensive travel (with reasonable accommodations being provided).
12.
Ability to fulfill administrative responsibilities from a home office when not traveling.
13.
Spoken and written English language proficiency.
14.
Ability to represent and infuse content with Cancun.com brand values.
15.
Demonstrated performance of applicants’ interview (for finalists only).
16.
Overall merits of each candidate.

HOW TO APPLY

To apply and be eligible for the CEO position, eligible applicants must, during the Campaign Period (Nov 8, 2017 - Dec 17, 2017) complete the following:
Eligible Applicants (individuals and teams) must:
a.
Create a 60 second or less application video in English, making a creative case for why they (or their team) should be considered to be the CEO. This video must be uploaded to YouTube or Vimeo. Videos must have monetization settings turned off as to not disrupt the viewer experience. Videos must comply with the conditions set out in "Application Submission Terms." Video submissions may be tested for quality assurance and those with poor sound and vision quality; incomplete or inaccurate application forms will not be eligible for the position, so make sure these issues have been solved before you upload to YouTube.
b.
Follow Cancun.com on the following Social Media Channels:
c.
Complete the CEO Application form at ceo.cancun.com/apply-now. Applicants should take care to make sure to list their correct email address in the application. This information will only be viewed by Cancun.com and will not be sold or made publicly available. Applicants must comply with the media release and Terms and Conditions in order to be considered for the position.
d.
Applicants must upload a profile photo in order for the application to be processed. Images should be between 240 x 240 pixels and 500 x 500 pixels for optimal uploading. Images must comply with the conditions set out in "Application Submission Terms."
e.
Candidates should review their application prior to final submission. Applications cannot be changed after they have been submitted.
f.
After the application has been submitted, and so long as eligible applicants adhere to these Terms, the application is then eligible for the CEO position and the Applicant becomes a Candidate.
g.
Any entries that do not comply with the conditions outlined in "Application Submission Terms" will not be an eligible submission and may be removed from the Campaign if the application is found to violate Submission terms.
The successful submission of an application will be confirmed by an email sent to the address provided by the applicant. This should be received by the applicant within minutes after they complete their application. In this same email, Candidates will also receive suggested instructions on how to gain support for their candidacy from personal contacts or social media followers via a Cancun.com branded Applicant Kit.

TEAMS

Both Individuals and Teams (groups of individuals who elect to share and/or split the position, boarding space, and all other benefits) may apply for the CEO position. Equal consideration will be given to both individuals and teams during the judgement periods.
Teams
a.
A "team" is defined as any application with the "team name " and "team members" section of the application filled out.
b.
Each team will have a primary applicant or a "captain" who fills out application. The captain will be responsible for filling out the application and i ncluding their team members’ names in the appropriate fields.
c.
A team may only have one application.
d.
New members cannot join a team after the application has been submitted.
e.
Any individual may only apply to the CEO Search Campaign once and only once, either as part of a team or as an individual.
f.
The Team Captain must fill out the application, and indicate that they are willing to assume the responsibilities of being the point of contact for the Company.
g.
Individuals under eighteen may be listed as team members provided that the captain of the team is the legal guardian of said individuals.
h.
No dogs, cats, or other animals may be included on an application as a team member.
i.
Teams should be sure to introduce all of their members in the first video, or else it is unlikely that the application will proceed in the hiring process.
j.
The Company will not gather information about team members unless the application makes it to the Top 50 round, at which point they may be required to provide the same information as the the primary applicant would at the same point.
k.
If a team is selected to attend the Top 5 Interview event, all team members will be required to share one room during the event. However, transportation costs will be covered for each member listed.
l.
If a team application is selected for the CEO position, total compensation and accommodations for the CEO will remain at $10,000/month with 1 room provided at a time by hotels and resorts during the duration of the CEO’s contracted stay in Cancun. This will be paid out to the primary applicant.
If a team application is selected for the CEO position, all members listed will be expected to participate in the CEO position and live in Cancun for the duration of the contract unless otherwise agreed upon by the team and the Company.

APPLICATION SUBMISSION TERMS

1.
Application Content Requirements: An application must not contain, as determined by Cancun.com CEO Search in its sole discretion, any content that:
a.
is sexually explicit or suggestive, is profane or pornographic, or contains nudity, profanity or obscenity;
b.
is unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group;
c.
promotes illegal drugs, firearms/weapons (or the use of any of the foregoing), promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
d.
promotes cruelty to animals or humans;
e.
promotes the irresponsible use of alcohol, or is obscene, offensive, inappropriate, or endorses any form of hate or hate group;
f.
contains a video that has already been submitted by the applicant in another application or otherwise appears to duplicate any other submitted entries;
g.
defames, misrepresents or contains disparaging remarks about other people or companies, or contains any personal identification, such as license plate numbers, personal names, e-mail addresses, or street addresses;
h.
contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, or overt company or product branding (including URLs or phone numbers), even with permission;
i.
is a mash up of images or contains copyrighted materials (including music) owned by others (including photographs, sculptures, paintings, and other works of art or images, television, movies or other media), without permission (should applicants wish to include any music in their video that is not their own original composition, they must ensure that they have the necessary copyright permissions);
j.
contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, or contains look-alikes of celebrities or other public or private figures, living or dead;
k.
is culturally inappropriate, demeaning or derogatory;
l.
communicates messages or images inconsistent with the positive images and/or goodwill Cancun.com wishes to associate; and/or
m.
violates any law or infringes the rights of any person, corporation or entity.
2.
If an application contains images of an alcoholic beverage, including the consumption of an alcoholic beverage, entries must present a mature, balanced and responsible approach to the consumption of alcoholic beverages, and therefore must not encourage excessive consumption or abuse of alcohol and must not encourage under-age drinking. Whether or not an application complies with this paragraph shall be determined by Cancun.com in its sole discretion.
3.
By entering the Campaign, eligible applicants represent and warrant that:
a.
their application is original and they own the application and have the right to assign or license copyright and any other intellectual property rights in the application to Cancun.com CEO Search on the terms of these Terms;
b.
their application does not, and Cancun.com’s use of the application on these Terms will not, violate the privacy rights, copyright, contract rights or other rights (including but not limited to intellectual property rights) of any person, corporation or entity;
c.
their application does not contain content that is, or their conduct in creating the content was not, illegal, contrary to any laws, indecent, obscene, threatening, discriminatory, harassing to any person, in breach of any confidence, defamatory, libelous, offensive or objectionable;
d.
if the application in any way includes third parties or third party property, they have obtained the required consents and releases from those third parties (or third party property owners) to include them in their application.
e.
if the application in any way includes images or footage of locations that require permission, permits or releases to be obtained for the commercial use of the image or footage, they have obtained the required consents and releases from the appropriate owners/authorities; and
f.
if the application in any way includes third parties under the age of 18 years, they have obtained the required consents and releases from the parents or legal guardians (as applicable) of those third parties or the third party property owners to include them in their application.
4.
Applicants: By entering the Campaign, eligible applicants grant Cancun.com and Partners a non-exclusive, worldwide, royalty-free, non-transferable license to use, reproduce, publish, store, and communicate to the public the application (or the video that forms part of the application) on Cancun.com and Partner owned and operated websites and Cancun.com and Partner's social media sites for a period of 5 years from the start date of the Campaign.
5.
Should Cancun.com wish to use an application in any other way (for example, in mediums other than online; for a period beyond the license term; or to sub-license the image to a third party), Cancun.com will contact the applicant and negotiate license terms and appropriate compensation (if appropriate, depending on the nature of the use and as determined in Cancun.com’s sole discretion) on a case-by-case basis.
6.
Eligible applicants acknowledge and agree that the license granted to Cancun.com and Partners includes the right to edit or translate any text that forms part of the application and that their video and translated text may be used on Cancun.com and Partner owned and operated websites (including local versions of these websites overseas) and Cancun.com and Partners' social media sites for a period of 5 years from the start date of the Campaign. Applicants also acknowledge and agree that the video component of their application may be retouched to make the video suitable for display in a particular media (which would only be for display on Cancun.com or Partner's websites or social media sites in the case of non-winning entries). Cancun.com will at all times ensure any modifications or edits to any part of the application are minimal and maintain the original essence of the application. Entries will be credited as per paragraph 6.
7.
Finalists and Winners: By submitting to the Campaign, becoming a finalists and/or accepting the CEO position, the candidates grant Cancun.com and Partners a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable license (with a right to sub-license) to use, reproduce, publish, store, modify, adapt, create derivative works from, broadcast and communicate to the public the application (or the video that forms part of the application) in all media applications. Winners acknowledge that their application may be used by Cancun.com, Partners, Cancun.com related entities, agencies engaged by Cancun.com, or any other third party nominated by Cancun.com, current and future promotional and marketing purposes without further reference or compensation to them. Winners acknowledge and agree that Cancun.com may edit or translate any text that forms part of the application and that their video and translated text may be used in all media in perpetuity. Winners also acknowledge and agree that the video component of their application may be retouched to make the video suitable for display in a particular media. Cancun.com will at all times ensure any modifications or edits to any part of the application are minimal and maintain the original essence of the application. Submissions will be credited as per paragraph 6.
8.
Media Credit: Cancun.com intends to credit all submissions (whether winning or non-winning submissions) displayed in any media (either on Cancun.com’s websites or social media sites for non-winning submissions or in any media for winning submissions) with the eligible applicant's first name and last name on websites and other media. If Cancun.com wishes to amend or adapt an application or do anything that would infringe the original essence of the application (apart from the edits/translation of the text or retouching of the videos as outlined in Terms) it will seek consent from the eligible applicant to do so on a case-by-case basis. Eligible applicants acknowledge that:
a.
Submissions may be reviewed by Cancun.com to ensure that they comply with the Terms, and consequently whether they are an eligible applicant or not, which will be decided in Cancun.com’s sole discretion;
b.
Cancun.com may notify applicants if their submission is invalid or rejected because it does not comply with these Terms, but is under no obligation to do so;
c.
Cancun.com intends to post the top 100 eligible candidates on the website located at ceo.cancun.com/ceo, however Cancun.com is under no obligation to post eligible candidates to that website and makes no representation and provides no guarantee as to when candidates may be posted to that website; and
d.
Cancun.com has the right to use submissions in any media or in any way it sees fit.
9.
Candidates certify that by submitting the application, their employment and job duties with Cancun.com, if hired, are not prohibited or limited by, or in conflict with, any non-compete or any similar agreement between the candidate and any current or former employer or any other third party.

CANDIDATE EVALUATION AND CEO JOB

1.
This Campaign is a real job for one six-month, consecutive employment contract with a possibility of extending for a second contracted period after the first period has concluded. Chance plays no part.
2.
There will be several stages of candidate evaluation:
Stage 1 – Call for Applications and Voting Period (Nov 8, 2017 - Dec 17, 2017)
Submissions (Nov 8, 2017 - Dec 17, 2017)
a.
Submissions will be accepted at ceo.cancun.com/apply
b.
Upon submitting an application and application video, all applicants will receive email confirmation from Cancun.com with information on how to share their video and obtain votes. This does not indicate that the video has been reviewed for candidacy.
c.
Applicants are encouraged to secure support for their candidacy from personal contacts through email or social media outlets.
Voting (Nov 8, 2017 - Dec 24, 2017)
a.
The voting period for any application begins as soon as the application has been completed and a profile URL has been issued to the Candidate, but the voting period will close for all applications on Dec 17, 2017, at 11:59 PM MST.
b.
Candidate supporters will be able to vote on an individual profile once every 24 hours. Votes must be made on each Candidate’s official profile, hosted on ceo.cancun.com. "Likes" given on social media platforms (Facebook, Twitter, Instagram, YouTube) will not be recognized by the Company.
c.
Candidates should not use spam tactics (e.g. purchasing email lists) or bot tactics (e.g. vote automation) to garner votes. Use of either of these tactics may result in expulsion from the Campaign. Candidates may only ask for voting support from people who the Candidate can infer would consent to receiving contact or notification from them.
d.
Candidates should understand that individual applications with high quantities of votes will not necessarily be moved forward in the hiring process. What is the purpose of a vote, then? The Company, Cancun.com, is seeking a Candidate who will be able to engage, sustain, and mobilize audiences. Capturing votes gives the Company an idea of which candidates are able to do this effectively-- whether their audience is composed of 500 or 500,000 people. A candidate who amasses 0 votes, for example, will most likely not be selected to progress in the hiring process, even if their video is very well done. Similarly, a candidate who amasses a large number of votes but who has submitted a low-quality video will most likely not be selected to progress in the hiring process. The announced Top 100 Candidates will be selected based on a to-be-determined combination of these factors that is left to the discretion of the Company.
Stage 2 – Selection of Top 100 Candidates (Dec 25, 2017 - Dec 26, 2017)
a.
Eligible applications received during the Campaign will be reviewed by a panel of Cancun.com representatives in accordance with the qualifications set out for the CEO.
b.
Applicants being considered as Top 100 Candidates may be contacted and be required to submit additional applicant information including but not limited to address (if located outside of the US) and additional information.
c.
The panel of Cancun.com representatives will select the Top 100 Candidates who will be notified by email on or before December 27 2017 that they have been selected to progress to the next stage of the hiring process. They will be asked to make a second video based on a new prompt, which is required in order to continue to be eligible for the position.
d.
All other applicants (those who were not selected) will also be notified on or before December 27, 2017 that they will not be progressing in the hiring process.
Stage 3 – Top 100 Candidates Invited to Submit Videos (Dec 27, 2017 - Jan 4, 2018)
a.
Between December 27 and January 4, 2018, the Top 100 Candidates’ profiles (with original videos) will be displayed on ceo.cancun.com.
b.
On January 5, 2018, a second panel of Cancun.com representatives will evaluate videos from the Top 100 Candidates second videos. From this selection of videos and applications, they will select the Top 50 candidates.
c.
The same Submission Terms given in the Terms and Conditions will apply to these videos.
Stage 4 – Top 50 Candidate Voting Period (Jan 5, 2018- Jan 13, 2018)
a.
During this stage, the Top 50 Candidates will again be invited to garner personal and social media support and accrue votes on their profiles.
b.
Profile URLs will remain the same throughout the competition.
c.
The same voting guidelines given in Stage 1 will also apply during this voting period.
Stage 5 – Top 5 Candidates Selected (Jan 17, 2018)
a.
On January 17, 2018, the final Top 5 Candidates will be contacted by phone/email to be informed of their selection, and may be asked to submit additional information. They will be invited to the Top 5 Interview Event, which will take place in Cancun.
b.
Final Candidates must be willing to participate in the formal interview, including various activities during the interview process. Activities may include individual and team challenges, physical and skill based assessments. All finalists must be willing to participate in these activities.
c.
Chosen candidates may decline to move forward, in which case, we will select another Candidate.
d.
All other applicants from the Top 100 (those who were not selected) will be notified on or before January 18, 2018, that they will not be progressing in the hiring process.
e.
The Top Five Final 5 Candidates will be announced on our website and social media Channels following the acceptance of the finalists, on or around January 18, 2018. Their profiles will also be displayed on ceo.cancun.com and www.Cancun.com.
Stage 6 – Top 5 Candidates Interview Event (Jan 26, 2018 - Jan 31, 2018)
a.
The Final 5 Candidates will participate in an extensive interview selection process which will be held in Cancun, Mexico.
b.
Finalists must be willing and able to travel to Cancun for approximately 1 week during the last week of January to be interviewed onsite.
c.
In order to participate in the Interview Event, the finalists may be required to provide a release and indemnity in favor of Cancun.com in respect to their participation in the Campaign and acceptance.
d.
The Top 5 Finalists may be required submit additional information to support their application including, but not limited to:
i.
Previous work history and current employment
ii.
Identity verification
iii.
Background check
iv.
Relevant medical history and drug test
v.
Written assessment of English
vi.
Any existing contracts or other impediment that may impact employment with Cancun.com.
e.
Economy air travel (return to and from the interview destination and the airport in the applicants’ closest commercial airports) and hotel accommodation will be arranged and paid for by Cancun.com.
f.
Cancun.com will also provide all finalists with comprehensive travel insurance prior to attending the Interview Event.
g.
Visa applications and associated costs will be covered by Cancun.com or its nominated agents for each of the Final 5 Candidates.
h.
Finalists are responsible for arranging their own passports and any associated costs.
i.
During the Interview Event, applicants must be of good moral character and not be under the influence of medications, drugs or other substances which may impair their ability to undertake their employment responsibilities.
j.
The final applicants will behave in an appropriate and professional manner as befitting their potential representation of Cancun.com.
k.
Any illegal, or inappropriate behavior on the part of the finalists will result in immediate expulsion from the selection process.
Selection and Announcement of CEO (Jan 31, 2018)
a.
Cancun.com will announce the appointment of the CEO at a live video event on January 31, 2018. Details will be displayed on www.cancun.com. This will officially end the Cancun.com CEO Search Campaign.

VERIFICATION

1.
If requested by Cancun.com, the Top 50 Candidates must produce, within the time requested by Cancun.com, appropriate documentation required to verify the identity and eligibility in compliance with these Terms. If the items required by Cancun.com are not received or a Top 50 Candidate has not been verified to the satisfaction of Cancun.com within the time period required, the applicant will be ineligible.

EMPLOYMENT

The successful Cancun Experience Officer (CEO) applicant will be required to enter into an employment agreement incorporating, at a minimum, the following conditions. All applicants must confirm their acceptance of these conditions.
1.
The CEO must be available to work fulltime for a six (6) months’ contract employment period from approximately March 2018 through August 2018 and accommodate travel for extended periods of time.
2.
The CEO will receive an initial six (6) month contract. Another six (6) month extension based upon professional performance guidelines may be offered, as established by Cancun.com.
3.
Should the CEO applicant fail to perform satisfactorily then Cancun.com reserves the right to terminate employment and pay the successful applicant his/her pro rata portion of said salary to the termination date.
4.
Cancun.com reserves the right to cancel the Campaign or CEO position for any reason.
5.
The CEO is responsible for making any necessary arrangements with applicant’s current employer in anticipation of an extended absence from home.
6.
CEO employment responsibilities will include but not be limited to the following:
a.
Visually engages Cancun.com users through story-telling, exploration, and the uncovering of activities, events, places, and people that exemplify what Cancun is like.
b.
Provides frequent updates to Cancun.com’s social media platforms.
c.
Sustains Cancun.com user engagement through ongoing communications on designated platforms.
d.
Performs local "VolunTourism" activities at selected destinations.
e.
Captures experiences with both digital photography and videos.
f.
Represents Cancun.com as its Local and Brand Ambassador as well as designated Experience Officer.
g.
Participates in media, marketing and industry events as required
h.
Withstands the physical demands of extensive domestic/international travel and activities with reasonable accommodations
i.
Demonstrates continued English language proficiency
j.
Maintains a positive and self-motivated outlook; acts responsibly and demonstrates good moral character.
k.
Fulfills administrative responsibilities from a home office when not traveling.
l.
Meets or exceeds Cancun.com’s performance guidelines.
7.
The CEO must be willing and able to meet a wide range of physical demands expected of the position with reasonable accommodations. Examples of these demands may include but are not limited to extensive travel, hiking, kayaking, swimming, zip lines, etc.
8.
The gross semi-annual wage of USD $60,000 (for six months) is inclusive of superannuation, allowances, benefits and an amount of applicable income tax which shall be withheld. The wage will be paid on a bi-weekly basis during the period of employment.
9.
Accommodation during business travel will be provided by Cancun.com or its nominee during the period of employment for the CEO. However, the CEO will be responsible for the cost of meals, beverages, mobile phone, and personal items.
10.
In the event that family or friends wish to accompany the CEO, any associated costs in doing so are entirely at their own expense and all necessary paperwork (e.g. passports, visas, travel insurance) will be the responsibility of the accompanying party.
11.
Cancun.com will own all intellectual property in reports, diaries, blogs, photos and other material created by the CEO during the course of their employment.
12.
Cancun.com reserves the right to monitor and edit material produced by the CEO in line with its corporate communication and marketing guidelines.
13.
During the employment period, the successful CEO must:
a.
Meet professional performance guidelines and expectations of Cancun.com.
b.
Exercise reasonable skill, care and diligence in the performance of the services in accordance with the standards of Cancun.com
c.
Act responsibly and demonstrate good moral character as determined by Cancun.com
d.
Should these requirements not be met, Cancun.com shall be entitled to terminate the employment agreement at its absolute discretion.

GENERAL

1.
Submission into the Campaign, involvement in the selection process and the following employment is entirely at the applicant's own risk. Applicants release Cancun.com and each of its respective officers, directors, agents, representatives and employees, and all others connected with the selection process and the subsequent employment, from any and all claims, actions, damages, liabilities, losses, costs and expenses, in any way arising out of or in connection with involvement in the, Campaign, selection process and employment, including, without limitation, any and all claims, actions, and liabilities for injury, loss or damage to the Applicant, to anyone else or to any property, regardless of whether or not such injury, loss or damage was caused by the negligence or misconduct of Cancun.com, its nominees or any of its respective officers, directors, agents, representatives or employees, or anyone else connected with the Campaign, selection process and their employment. The Applicant agrees to indemnify Cancun.com and its nominees and each of their respective officers, directors, agents, representatives and employees, and all others connected with the Campaign and hold them harmless from any and all liabilities, claims, actions, damages, expenses and losses (including, without limitation, legal fees) of any kind or nature whatsoever in any way caused by or arising out of their i nvolvement in the selection process and their employment.
2.
Applicants may submit one application for the CEO Search in the Campaign once only.
3.
If an applicant submits more than once for the CEO position or otherwise breaches these Terms, Cancun.com may block that applicant from submitting any further entries and will be considered ineligible for the position.
4.
Applicants can only apply to the Campaign in their own name.
5.
Cancun.com reserves the right to vary the Campaign Period and any other dates relating to the Campaign, and will post any updates to the website.
6.
Cancun.com similarly reserves the right to alter or amend any of these Terms and Conditions during the promotion. Any updates or changes will be posted to the website.

The CEO position is not transferable, exchangeable or redeemable for cash.
8.
If Cancun.com is unable to provide the successful applicant with the job, then Cancun.com reserves the right to supply an alternative job of a similar experience to the original job.
9.
Cancun.com accepts no responsibility for any applications not received for any reason during the Campaign Period. No responsibility will be taken for lost, late, or misdirected entries. Cancun.com does not warrant that the application mechanism will be available at all times during the Campaign Period.
10.
If, for any reason, the Campaign is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the control of the Cancun.com, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Campaign, then Cancun.com reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Campaign.

Any applicant who, in the opinion of the Cancun.com, tampers or interferes with the application mechanism in any way, engages in any unlawful or improper conduct which jeopardizes or is likely to jeopardize the fair or proper conduct of the Campaign, or who does not properly comply with the application process, will be ineligible.
12.
Incomplete, illegible, indecipherable or incorrect applications are not eligible for the position.
13.
Cancun.com reserves the right to disqualify entries in the event of non-compliance with these Terms. Cancun.com’s decisions in relation to all aspects of the Campaign are final and binding on each applicant and no correspondence will be entered into.
14.
All costs associated or arising in connection with the position are the responsibility of the applicants. In particular, the following are not included as part of the CEO position and are the responsibility of the successful applicant: transfers to and from the departure airport, laundry services, telephone calls, spending money, extra activities and other ancillary costs not specified in the job description.

Cancun.com will allow the selected CEO to enjoy alcohol in accordance with local laws, age restrictions and in consideration of the moderate alcohol consumption guidelines found at the CDC website: https://www.cdc.gov/alcohol/fact-sheets/moderate-drinking.htm

PRIVACY STATEMENT

By submission to the Campaign, applicants consent to Cancun.com collecting, using, disclosing and storing the personal information an applicant provides in accordance with its general Privacy Policy available at http://www.Cancun.com/privacy-policy and the terms set out in this Privacy Statement.
2.
If an applicant submits personal information from the European Economic Area (the EEA), by doing so the applicant consents to it being transferred, stored and/or processed outside the EEA.
3.
Applicants may only submit an application to the Campaign on their own behalf, or as the contact point for their team.
4.
Appicants acknowledge that the personal information requested by Cancun.com in the application process is reasonably necessary for Cancun.com to administer the Campaign. This information will include the applicant’s legal name, nickname, phone number, email address and address. Applicants who are selected to proceed to subsequent rounds of the application process will be asked a number of questions about themselves, including but not limited to their hobbies, lifestyle, professional background and educational history. Cancun.com may also request sensitive information from applicants including but not limited to their medical history as it relates to the position, criminal record, background check and written English assessment.
5.
Cancun.com will use and disclose the personal information and sensitive information it collects from applicants to:
a.
administer the Campaign, including assessing entries, conducting interviews and judging the applicants;
b.
employ the selected candidate of the Campaign, including arranging visas and flights;
c.
create marketing and advertising campaigns featuring the selected CEO of the Campaign;
d.
send marketing and advertising materials (including by email) to applicants on the application form for the Campaign, which will be sent on an ongoing basis until the individual opts out of receiving the materials;
e.
share the information with its partners for marketing purposes;
f.
assess the success of the campaign and to plan for future campaigns; and
g.
for purposes related or ancillary to the purposes set out above.
